In a blistering ruling on Thursday, a three-judge panel unanimously agreed that a group of Donald Trump’s top officials
—including Homeland Security Secretary Kristi #Noem and Attorney General Pam #Bondi
—must fulfill a judge’s request for sworn testimony about their failure to heed her order demanding #Abrego #Garcia’s return.
“It is difficult in some cases to get to the very heart of the matter,” the Fourth Circuit ruling said.
“But in this case, it is not hard at all.”
The opinion—written by Judge J. Harvie Wilkinson III, a Ronald Reagan appointee—said that
Trump “is asserting a right to stash away residents of this country in foreign prisons without the semblance of due process that is the foundation of our constitutional order.”
“Further, it claims in essence that because it has rid itself of custody that there is nothing that can be done,” it said.
“This should be shocking not only to judges, but to the intuitive sense of liberty that Americans far removed from courthouses still hold dear.”

I'm not sure what it means that El Salvador reversed course and allowed Sen. Van Hollen to meet him after previously denying it. But there's more hope today than there was yesterday!

This breaches the platform's Terms of Service and should result in a suspension.
Today was a very good news day. Two federal judges moving towards holding administration people in contempt. A senator goes to #ElSalvador and learns information helpful to the #Garcia case.

But this meeting in the Oval Office was the most clear example yet that Trump had no intention of returning Kilmar Armando Abrego #Garcia to the United States, despite the #SupremeCourt instructions the U.S. government to take steps to return the Salvadoran migrant. Trump and Stephen Miller essentially scoffed at the Supreme Court’s ability to direct the administration to take any action on foreign policy and made clear that if anyone was going to return Garcia to the United States, it would have to be #Bukele. In her statement, Justice Sotomayor made several points it’s difficult to believe all nine justices on the Court couldn’t agree on:
- “The Government has cited no basis in law for Abrego Garcia’s warrantless arrest, his removal to El Salvador, or his confinement in a Salvadoran prison. Nor could it. The Government remains bound by an Immigration Judge’s 2019 order expressly prohibiting Abrego Garcia’s removal to El Salvador because he faced a ‘clear probability of future persecution’ there and ‘demonstrated that [El Salvador’s] authorities were and would be unable or unwilling to protect him.””
- “Instead of hastening to correct its egregious error, the Government dismissed it as an “oversight.””
+ “The Government now requests an order from this Court permitting it to leave Abrego Garcia, a husband and father without a criminal record, in a Salvadoran prison for no reason recognized by the law. The only argument the Government offers in support of its request, that United States courts cannot grant relief once a deportee crosses the border, is plainly wrong.”
