Attractive Nuisance<p>I'm thinking about practical steps for pushing back against the recent <a href="https://tech.lgbt/tags/UK" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>UK</span></a> <a href="https://tech.lgbt/tags/SupremeCourt" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>SupremeCourt</span></a> judgement against <a href="https://tech.lgbt/tags/trans" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>trans</span></a> people in the <a href="https://tech.lgbt/tags/UK" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>UK</span></a>, particularly after reading <a href="https://www.wearequeeraf.com/uk-supreme-court-rules-that-trans-women-arent-women-under-the-equality-act-2010/" rel="nofollow noopener noreferrer" target="_blank">Jess O'Thomson's analysis</a>. It's pretty clear that the transphobic fascists will be coming for toilets, changing rooms and women's sports next. Bear in mind that IANAL, but I work elsewhere in risk and compliance.</p><p>We need people (and particularly <a href="https://tech.lgbt/tags/unions" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>unions</span></a>) to provide template policies for places which want to keep such facilities open to trans women. This may include risk analyses to show that the harm of allowing trans women to use a women's facility is minimal compared to the risk of pushing them into the men's rooms. This will empower managers to push back against the impending TERF onslaught.</p><p>Anyone who does this will have to be prepared to be a test case of what this ruling means in practice, so we need orgs such as Good Law Project on standby to assist.</p><p><a href="https://tech.lgbt/tags/uk" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>uk</span></a> <a href="https://tech.lgbt/tags/lgbt" class="mention hashtag" rel="nofollow noopener noreferrer" target="_blank">#<span>lgbt</span></a></p>
